Yes, and you could also say that demons do not exist whether you believe in them or not, because belief by definition stands outside of proof. If you can prove it, you don't need to believe it. Okay, I don't know whether anyone needs this to be explained or not. It is self-evidently stupid to me, which makes it hard to explain, but I've missed a lot of things that are self-evident to others so... Point 1. The popular meme you were looking for is faith (not BELIEF) is believing in something without proof- you fuzzy yak. "If you can prove it, you don't need to believe it." No, pistachio-teeth... when you aren't sure if something is X and someone proves it to you, you then BELIEVE it is X. Belief COMES from PROOF with (according to the meme) one exception, and that is FAITH. FAITH is belief WITHOUT proof, you overpaid Farigno. For example- I would not BELIEVE that you get paid for displaying your pompous dumbassity without the PROOF before my eyes- namely that you have a television show and a column. Furthermore- at this point, despite an absence of PROOF that you are anything other than a rusty toaster intellect sans writing talent people have FAITH in your ability to judge movies. What makes all this worse, though, is point 2. Point 2. If your gloriously frozen gray matter's confusion of Faith with Belief wasn't bad enough to condemn you to Dante's 3.7th circle of hell (where monkeys throw hot feces into the mouths of dumb critics, thereby reversing what dumb critics do) the fact that you don't understand Faith, nor Proof, would. You're so dumb it is actually hard to belittle you; you have screwed up your use of a screwed up axiom. That axiom is the popular meme that faith IS belief without proof, which it is NOT. Faith often comes FROM proof- but it is not demonstrable proof- it is not repeatable truth- it is not, in other words, scientific proof. This is NOT the same as saying it comes without proof. You dumb dirigible. You indigestible planet. You flacid monkey. You sucktoid.

But some experts question why these states let Lilly help oversee spending on its own medication. “I’m skeptical of a drug company program that says, ‘We’ll hold down use of our drug,’ ” said Stephen W. Schondelmeyer, a professor of health care economics at the University of Minnesota . He described such programs as thinly disguised marketing. Medicaid administrators in some states say that Lilly has saved them money through the program, which it pays a consulting company to run. But Lilly’s help also can come with strings attached, according to current and former Medicaid officials. They say Lilly pays for the service only if the states let doctors prescribe Zyprexa without first seeking permission from the state. Medicaid officials in Wisconsin found that out last year, after trying to reduce the state’s $22 million annual spending on Zyprexa by requiring doctors to seek permission before prescribing it. Lilly responded by ending the program. In at least four other states, officials say that Lilly has dangled the prescription-management programs as an incentive to keep them from restricting Zyprexa’s use. Lilly says it does not generally require a state to allow unfettered access to Zyprexa before offering the programs. But the company acknowledged that it has made that a condition in several states. Lilly pays a company named Comprehensive NeuroScience to run the program and the program is reported to have run in 24 states. How are “bad prescriptions” managed? Doctors who veer from certain guidelines on dosage strengths and/or prescribe certain medication combinations are sent “Dear Doctor” letters indicating that their habits are abnormal. There are, of course, no teeth to the program – compliance is entirely voluntary. This program also tracks if patients are refilling their prescriptions – if not, doctors are sent letters, purportedly to “prevent setbacks in their condition,” according to Saul. Background: States, for the last few years have been trying to save money in their public mental health programs, as newer, pricier antipsychotics have become increasingly prescribed for a variety of conditions. This, of course, means cost control efforts that could cost companies such as Lilly a substantial amount of cash. Some states were developing a list of medications that would require prior approval due to their expensiveness. Many mental health advocacy groups rallied against such moves. Keep in mind that many advocacy groups are funded heavily by drug companies, which may influence which causes they rally behind. Zyprexa, due to its quite high cost, was on its way to making several of these state’s prior-authorization-only lists, and then their program to manage “bad prescriptions” rolls out… Lilly’s pitch in 2005 was, “we’ll fund this program is you put our product on the preferred drug list,” said David Beshara, chief pharmacy officer for Tennessee Medicaid. Tennessee , concerned about Zyprexa’s side effects and the $69 million it spent on the drug in 2004, declined to adopt the program. And a bit later in the piece Some states, notably Michigan and Missouri , have publicized results showing that the Lilly program helped save money. And they generally praise the program. “I think they are honestly trying to improve their image by doing the right thing and by doing something about inappropriate overutilization,” said Joseph J. Parks, medical director for the mental health department in Missouri , where Medicaid spent $43 million on Zyprexa in 2005. Dr. Parks has served as a paid consultant to Comprehensive Neuroscience. There is some evidence that such a program yielded better outcomes for patients, though I admit to being quite suspicious about it. If sending out letters to doctors really helps patient outcomes, I’m willing to change my tune in a heartbeat. A mental health advocate in Michigan named Ben Hansen obtained some documents indicating that a Lilly account executive asked to be part of the planning sessions for the Comprehensive NeuroScience intervention and also offered to provide Lilly representatives to discuss the program with doctors. Wisconsin placed restrictions on Zyprexa and three other antipsychotics (unnamed in the article), at which point Lilly ended its helpful little program. The state claims its spending on those drugs dropped by $4 million. Now let me be absolutely clear. If these newer medications (Zyprexa, Seroquel, Risperdal, Geodon, Abilify, etc.) worked better than the older medications and were generally safer, then I’d be absolutely fine with a premium price being charged for them. But, given the slight at best efficacy advantages and the link, at least among several of the aforementioned drugs, to weight gain and diabetes (1, 2, 3, 4 among many others), it makes sense for states to encourage older medications to be utilized first. Monday on High Stakes Poker we learned that if you want to put Freddy Deeb on TILT all you have to do is accuse him of ratholing, or "going South." Taking chips of the table is a big no-no in poker, and Freddy's tablemates, starting with Johnny Chan and then continued by Danny Negreanu continued to push his buttons, joking that he took chips with him when he went to the bathroom. Freddy went ballistic when they continued to joke about it, and demanded that the game be stopped. Eventually Freddy was pacified after Sheik gave him a rose - how sweet. Tuesday at the dog run Oscar learned that if a French Bulldog tries to hump your ass, the best defense is to a) put your ass on the ground and then b) turn and defend yourself with your teeth. Wednesday I learned that you need to be careful how you pick up soft dog poo with a small plastic bag so as to not get it on your hands. Yep - poop on the hands - and I didn't even freak out - I'm officially a dad. Thursday I learned that I owe the IRS stacks and towers of checks. Fuck me. As Dirty Dave put it, "That's the price of being KD." Today we went for a walk in the 'hood, and saw Catherine Zeta Jones filming a movie on Charles Street. There was a huge production crew there, and one of the set managers quickly fell in love with Oscar, recognizing him as the breed from "As Good as it Gets." I told the guy to put Oscar in the movie, but they already had some obnoxious Boston Terriers cast... We also spotted Matthew Broderick, who lives nearby, entering a townhouse right across the street from where the crew was filming. It was kinda funny seeing all these people stretching to catch a glimpse of Catherine Z-J across the street, and then Ferris Bueller himself walked right through the crowd, catching them off guard. -KD

In the meantime I am identifying all sorts of birds (list to be published in next blog... but includes the ostrich, the secretary bird and many raptors). At the waterhole in the evening, after a beautiful sunset and night has set in we arrive ton see and hear a spoted hyena drinking water. He leaves. It is still save for a drongo catching insects in the nightlights. Then along comes a makle elephant, looking white in the light... he make a tour of the hole and sdtays with us for half an hour while he drinks and splashes around and comes very close to Fred, reaching out with his trunk. Today starts off with a nervous jackal or two at the same waterghole (near our campsite), followed by springbok, hartebeest and four handsome male kudis. Fred calls me back for breakfast and we depart. Two lionesses at a waterhole. And later this afternoon..... a pride of lions.... four young babies, a number of mothers, some juveniles and a young male all together, an older male somewhat further off. Fifteen in total. Four young go off by themselves while the mothers are still resting... the mothers follow and eventually so do the males. Beautiful beautiful strong animals... this sort of experience really makes a three day trip like this worthwhile.. a once in a lifetime experience. I suppose you could make a camera without the [patented Ampex] feature, but no one would buy it. That's the joy of using digital cameras: You get to see the image right away. Royalties may also include what are known as "convoid" sales. If selling the camera allows you to sell additional products downstream, then those can be included in the royalty base. That will certainly be explored by the plaintiff. Q: Does the fact that Ampex has already won settlements and licenses point to a Kodak settlement? A: Ampex will try and rely on that. [The past settlement history] is pretty persuasive stuff. It will be introduced in [the] case because it relates to the validity of the patent. It is some evidence of commercial success. And commercial success would be evidence of nonobviousness. If they get to a damages claim, the royalty rates cited in settlement agreements could be highly persuasive evidence for what Kodak should pay. [Now] what it is doing is no different from what other patent trolls do. Q: Is so-called patent trolling on the rise? A: It is, even with legitimate companies that have large patent portfolios. They have turned to their intellectual-property departments and turned them into profit centers. Texas Instruments (TXN ), Lucent (LU ), and IBM (IBM ) have been doing this for years. Plus, the damage awards are huge. [The practice] has grown more vigorously over the past 10 years. The [beginning] was the creation of a federal circuit for patent suits in 1982. Patents are a powerful economic weapon. People sue left and right. The outgrowth of that is patent holding companies. They're like venture funds. They go around holding people up for lots of money. Q: What is the cost to society? A: Most people suing didn't do any of the invention. Money isn't going to the inventors. There's no socially useful purpose. It's a waste of resources. Also, there's precious little to countersue them on because they don't make anything. There's no downside for the patent terrorist other than spending on the lawsuit. He did nothing but file patent applications. He has the largest number of issued patents. He acquired patents in key areas of technology such as bar codes. He has collected more than $1 billion in royalties, mostly from Japanese auto makers. As a result, Congress changed the patent expiration dates from 20 years from filing, to 17 years from granting. Q: Who else could Ampex sue? A: The major digital photography companies will be targeted. Computer companies could be targeted. I can't say for sure since I haven't reviewed the patent. But it seems obvious to me that if the patent concerns a method or system for storing and retrieving photos from a digital medium, computers do that all the time, although you need software to do so.
