Even though I was working during winter break, I still managed to enjoy my time off. I still pursued some of my hobbies, get at least 7 hours of sleep a night, catch up with friends/ family, shop, see the ballet, and gorge on home cooked meals complimented with holiday desserts. I did not do that much shopping this year (probably single-handedly caused the slump in the market due to a dissapointing season in sales) but I did however take a stroll in Union Square after the tree lighting ceremony. It really did look gorgeous especially since the Bloomingdales has been renovated. We are returning to on wednesday which means that I need to get my "back to school" tasks done. Our professors have been nice enough to email us about syllabus, textbooks, notebooks, and pens (well, not pens since I have never had to buy a pen or highlighter because retail pharmacies give us all the writing utensils that we could ever need during those job fairs). Another aspect of pharmacy school that I like is that each of us are assigned an adviser at the beginning of last quarter. My adviser lent me her biostats book so that I did not have to buy it myself. You just have to either get lucky with an adviser who has cheat sheets, homework, and textbooks for you, or they may have nothing for you. Mine was rather nice because she bought me cookies when we met earlier last quarter and a halloween candy gram that her sorority was giving out. Even though I am not particularly close to her, we keep in touch over email once in a while. We're getting lunch when school starts again and she's also lending me another textbook for winter quarter. I plan to do something nice for her for her advice and all. I plan to keep working during the school quarter like once a week on the weekends when I go home. I can make enough to pay off my rent every month (yeah!). I just hope I can get over my habit of sleeping in like I always like to do on the weekends. Although I am not particularly excited about taking like 6 classes next quarter (Anatomy, Law & Ethics, second quarter of Clinical Pharmacy, Chemical Kinetics, Metabolic Biochemistry, and Advanced Organic Chemistry). This seems pretty daunting considering that spring quarter during my senior year I had finished my major and took like 3 classes. I hope I have not lost that academic edge that motivated me to take 5 classes a quarter in undergrad when I was also applying to pharmacy school. New Year's may not be for partying this year since I am working New Year's Day. Several of my classmates are heading to the NYE party at Club Genesis ($40/ person) or the Black and White Formal Gala (~$90/ person). Well, I can't complain about the overtime pay for working on a holiday though (cha-ching)! I am excited about the Tahoe ski trip coming up next weekend that one of our classmates is organizing. We will be going snowshoeing, skiing/snowboarding, and shopping in Reno.

Yet, as Mrs. Dynamite says, "There must be an awful lot of seeing eye dogs in our neighborhood," because there is a shitload of dog shit on the sidewalk (you don't have to pick up after a seeing eye dog, of course). Seriously douchebags: when your dog takes a shit on the sidewalk, you pick it up. That is non-negotiable. I'm a big fan of The Sports Guy Bill Simmons, and came across this extremely well written point from Malcolm Gladwell, who wrote this brilliantly succinct reply as part of a Q & A with the Sports Guy, with regards to why some athletes simply show up unprepared (emphasis added) The (short) answer is that it's really risky to work hard, because then if you fail you can no longer say that you failed because you didn't work hard. It's a form of self-protection . I swear that's why Mickelson has that almost absurdly calm demeanor. If he loses, he can always say: Well, I could have practiced more, and maybe next year I will and I'll win then. When Tiger loses, what does he tell himself? He worked as hard as he possibly could. He prepared like no one else in the game and he still lost. That has to be devastating, and dealing with that kind of conclusion takes a very special and rare kind of resilience. Most of the psychological research on this is focused on why some kids don't study for tests -- which is a much more serious version of the same problem. If you get drunk the night before an exam instead of studying and you fail, then the problem is that you got drunk. If you do study and you fail, the problem is that you're stupid -- and stupid, for a student, is a death sentence. The point is that it is far more psychologically dangerous and difficult to prepare for a task than not to prepare. People think that Tiger is tougher than Mickelson because he works harder. Wrong: Tiger is tougher than Mickelson and because of that he works harder. I read one of Gladwell's books, Blink, which was mildly interesting, but he is clearly a very talented writer and psychological thinker. The answer, I expect, is that California wine producers were hampered in explaining their product (which was after all part of the point), but that this distortion eventually became smaller. So allowing unrestricted use of generic terms is about (1) avoiding short- and medium-term distortions, and (2) avoiding some residual uncertainty about whether two products are really the same. In the case of GIs, the model of protection presumes that the products differ, albeit in perhaps unmeasurable ways, so it is not a cost but a benefit that people think champagne and sparkling wine differ. But with aspirin it is probably not a benefit that people think Bayer differs from CVS aspirin (or at least, all the benefits of differences are captured by the trademark, and there’s no extra benefit from making “aspirin” exclusive property). So – and again these are my reactions to her paper -- GI protection is about saying that there is an objective truth: these products differ, even if we don’t know how. The protection exists regardless of consumer perception. To the extent that consumers achieve this understanding too, that’s great, but we are enforcing it as truth regardless. Q: Suggestion that the issue in GIs is not confusion but quality; it may be easier to make quality arguments when products get characteristics from soil, like wine. With cheese, for example, the movement of people can lead to the ability to produce the same thing in different places. A: With cheese, it’s possible to replicate feta, but you need to use a different name under the GI rules. Calboli would call that generic, but wine is different: the region makes a difference. Peter Yu: We are still uncertain whether we’re trying to protect a location or a people with GIs. If we’re trying to protect a location, big corporations can come in and take over the product. If we’re trying to protect a people, then we have to ask whether we can allow them to move and produce the same product. Calboli: Protection shouldn’t be tied to producer size. Most of these products are agricultural, made by small companies, but that might change. Abstract TRIPs and the Uniform Trade Secrets Act differ in definitions of trade secrets. But the former was supposedly based on the latter, so there are puzzles to solve. Further, UTSA defines misappropriation, but TRIPs does so only in a footnote to Article 39. Pharma cos are trying to use Art. 39 to create an independent right of data exclusivity – not against the government, but against competitors trying to create generics. She is disturbed by this. Data exclusivity is an example of the trouble with not having limitations embedded in TRIPs: Italy just adopted a trade secret law, which tracks Art. 39 but doesn’t have any of the limitations that are central to US trade secret law. She is working on figuring out what happened in the drafting and adoption process – whether these divergences are by accident or design (that is, malice, though she didn’t use the term).

From George Doyle, May 23, 2007 Subject: Out of State Trips Constance: I have received numerous complaints from my members about authorizing out of state trips for STRS board members. It seems to me that if these board members feel it is so beneficial; perhaps they could pay for their own trips and if the board, after receiving documented reports from the meetings, determines that this was valuable to the whole board and the retirees, then reimburse them for their expenses. I feel that too many times conferences seem worthwhile on paper but when you actually get there very little information is of value to take home to the rest of the group. Please try to exercise better judgment in the future. We retirees have suffered enough at the hands of the Board. Please listen to Dr. Leone and John Lazarus when they speak. Unlike some, they are not just speaking to hear themselves speak. They are taking the action for the retirees that needs to be taken. I have become very disappointed with you because you promised me at the Spring Representative Assembly when you were running that you would do all in your power to protect our retirement. So far you have not lived up to one of your promises! I find that I can no longer have any faith in what you said and I will do my best to try to get someone else in there that will respect the position for which they were elected. George V.
