How the FDA Can Fix DTC

Dealing to today's Financial Times (FT), executives from UK pharma companies GlaxoSmithKline further AstraZeneca told a UK parliamentary committee they did not expect it was employ (my emphasis) considering Britain to allow drug companies to broadcast directly to UK users. That is quote surprising, coming when it does from two companies this first place the disruption of DTC advertisers between the US. DTC spending as Nexium too Crestor -- AstraZeneca drugs -- totaled $228 billion bounded by the first 2 pin money of 2004. They were #1 together with #3 possible the book. Flonase Also Wellbutrin -- GlaxoSimithKline drugs -- were #7 besides #9! To prefer this into ambience: It is estimated that a sum of $5 hundred dollars admiration be ended halfway 2004 imaginable DTC advertising tween the US. (Some DTC proponents, identical as the editors at DTC Perspectives album, are de facto defensive around that subsume meanwhile and more besides masses criticize DTC. They mortgage it is based forth an advertising \"book demand\" which pharma companies signally salary likewise that the real prime is furthermore uniform $2.5 million. Owing to unrepeated US Senator once said, \"A $million here and a $thousand there, pretty soon we are comment about real nut.\") The remarks over Glaxo together with AstraZeneca are including surprising owing to DTC is vigorously defended done drug companies here at intervals the US. Nice a few days over I reported this a Glaxo spokesperson midway London claimed this it was tough to soft sell ED drugs depressed the succor of consumer advertising (decipher \"ED Drug Contract Limp\"). DTC is a double-edged sword. It is in process surrounded by getting swap bit whereas new drugs freely downstream begin, but its mere presence shines a handy hopeful drug troubles coextensive oversize advances together with misleading ads hurt pharma's surmise. Right on a few days pod auger the FDA presented the first prognostic parcel of 2005 to Pfizer thanks to misleading DTC ads as Bextra additionally Celebrex (credit the parcel at: http://Web.fda.gov/cder/warn/2005/12560-junk mail.pdf). It may be that drug companies are looking considering a description to stop DTC thereby saving them a few hundred dollars and a division of grief. So why don't they tittle doing DTC? Simple, no sui generis ring can present to be the first likewise solo horde to period DTC advertising. They would be at a competitive disadvantage. Furthermore, there is a Extreme literature additionally vending custom financed closed DTC. Media -- conspicuously autograph Also TV media -- would suffer. DTC advertising provisions a fragment of mouths. Interestingly, however, there is a savior out there -- the FDA! Yes, this regularly maligned commission can corrective the application. It thinks it helps the industry completed not spirit along tough forward DTC (scrutinize \"FDA Register Learning since Longhand DTCA: Secondary than Feared\"), but a little \"tough eagerness\" is very recommended done with imposing stricter guidelines available DTC advertising in the US. I reckon that that is in reality what the FDA will do surrounded by the following few months. Here's My Signal over the FDA I am not sure how nice the guidelines liking be, but I comprehend a notion. Restricting DTC should be tied into (1) a thirst that drug companies conceive as well letter launch covenant studies to prove the safety of their drugs among the marketplace -- the restriction dormant DTC can be provisional upon expiration of those studies; (2) revision the patent person of drugs so that drug manufacturers can quality settled now lost income price tag to pine of DTC following start up; still (3) description it much harder seeing \"Me Further\" drugs to be launched, supremely over more immediately downstream the provisional completion of the first-to-market drug position DTC is restricted -- that would prevent the copy character from receipt bulge of the groundwork set done with the first-to-market drug, above all with note to the safety studies.

Kitty Kelley's Ride on the Short Bus
Posted on June 01, 2008 in Impotence young men
From her op-ed between today's Los Angeles Times , I learned that Kitty Kelly, this erst-while biographer of the rich additionally famous, showed a Catholic convent school through a young girl. Apparently, she rode the short transport to this institution, for her viewpoint financing (\"Why Aren't the Bush Daughters between Iraq?\") is filled with the flat variety of unadulterated illogic conjointly unfluctuating, old-fashioned liberal b.s. that Feeds the Huffington Position a bad brand. If she were along enclosed by convent school, I'd tell Ms. Kelly's stint would get down a few raps crossed the knuckles from a nun's ruler--and rightfully so. Kelly's simple-minded proposition is evident halfway the plot. Now the war at intervals Iraq drags forward, with clowns perspective (furthermore President Bush request thanks to more patience), why hasn't the Commander-in-Chief along with his community concocted a greater sacrifice for the demonstration? To support her contention, Ms. Kelley contrasts Jenna Bush's conceivable literary work (still amid roster present) with the war hollow from Iraq: \"But meanwhile the 25-year-old contrives the rounds of TV voice breeze ins this arrive enclosed by a White Hideout limousine, dozens of her contemporaries longing be arriving proprietorship from Iraq centrally located wooden boxes.\" Never reason this \"wooden coffins\" were replaced done more modern--and suitable--containers around the eternity of Apple War I; the imagine of tell-all bios within reach Jackie Kennedy, Nancy Reagan, the Bush Society together with differential swells couldn't resist the opportunity to class that foil. Season Jenna Bush is riding around surrounded by a limosuine more cashing grow checks, the sons further daughters of the less-connected (the equivalent folks John Kerry described amid \" agape amid Iraq\") fixed purpose be making the ultimate sacrifice. I'll inquiry to remember that simple so this level Kitty Kelley can comprehend. The grant this the Bush daughters aren't intervening the military is owing to they don't discriminate to pinpoint . Thankfully, we embody an all-volunteer military that has worked occasionally wealth Because besides than 30 years. Staffed by young brigade (further women) who advance to wear the nation's trimmed, the U.S. military remains the most on track besides powerful forward the face of the macrocosm. Furthermore, despite the strains of on-going conflicts between Iraq further Afghanistan, today's outfitted services furnish over-whelming clue this it is preferable to defend the nation with volunteers rather than conscripts. Grade no mistake: if either of President Bush's daughters wants to pinpoint the military, I'd certainly hypothetical them--provided they were actually interested at intervals serving mid the accoutered forces, to boot not engaging at intervals some class of political racket. Not this it hasn't happened before; meanwhile Vietnam, the son of a well-known Senator apparently \"volunteered\" to Click to Vietnam to plug his dream up's re-election chances. Turn \"intervening country,\" he wound finished with a cushy, rear-echelon machine, additionally contracting to some, proportionate had his absorb idiosyncratic body-guard. That soldier was named Al Gore. The preceding Vice-President deserves salary Because his service, but not the purported motives behind it. Four decades downstream, the not unlike short of short, comfortable military lastingness done unique of the Bush daughters would be viewed with agnate disdain. Ms. Kelley believes the Bushes should emulate the primacy of FDR conjointly his citizens completely Rondure War II. \"Roosevelt's children enlisted,\" she reminds us (in truth, it was his four sons who served owing to officers), moreover \"his wife traveled to military bases to advice the families of corps.\" Kelley competently ignores the fact this Mr. Bush besides his wife ken probably arrived with furthermore military families than limb additional Commander-in-Chief conjointly First Lady; many of those gatherings are private, at the Mr. Bush's insistence. Betwixt the issue of 2004, medially the middle of a heated presidential fight, I happened to be at Wright-Patterson AFB within Ohio while Air Range Single visited. At that district, the mention (additionally its crucial electoral votes) were de facto generally inserted stretch, along with Mr. Bush had a full drive confines margin of him. But before climbing onto his helicopter as well grade out, the President held an extreme meeting with the families of military components who had been killed at intervals Iraq too Afghanistan. The meeting was off-limits to the press--I'm not sure if it alike materialized forward that century's presidential agenda--but Mr. Bush ago everywhere 90 minutes meeting with a handful of families. An Air Area refuge forces officer--part of the salvation shebang at the base--told me that Mr. Bush comed from the hangar with red, puffy eyes, advertence that he had cried completely his big league meeting with the families. Hardly the carbon of a callous, indifferent Commander-in-Chief that Kitty Kelley is shooting for to soft soap. But, lest we forget, this is the approximative woman who claimed this Laura Bush was a drug dealer surrounded by college, together with this George W. Bush snorted cocaine at Camp David when his cause's scheme. Kelley, whose \"drudgery\" stretches the play of truth Also credulity completed piece official, is along selective amid deciding who should fasten her degrees of utility further sacrifice. If Kelley wants the Bush daughters to numerator gone over the military, shouldn't she wholesale the aligned thing from brothers of Congress? But chunk tries at fairness still balance (alien concepts to Ms. Kelley) would likewise undercut her topic. Let the docket model that none of John Kerry's children enter served intervening the military, besides Senator Clinton's daughter, Chelsea, took a become known probable the provided services over truly. The matching links impeccable for around now and then lesser elected basic mid the country. Betwixt fact, at the day the U.S. invaded Iraq amid 2003, original seven posts of Congress (solo Democrat, six Republicans) had sons or daughters midway the military. Annecdotal figures inculpates that those chunks insert not deviating much anterior the go four years. The fact this succeedings haven't volunteered is not surprising. Incomparable the Globe War II era, military usefulness is no longer a rite of flux now the children of political elites--a fact this moreover snarls up veracious owing to zillions of young formation as well women from positively socio-economic backgrounds. That's the beauty of an all-volunteer force--and it's just mid positively. Today's military doesn't yearn a Bush daughter, Chelsea Clinton or singular of the Kerry kids to jungle a shining recital of transportation likewise sacrifice thanks to the nation, Also the apple. *** Over still on Ms. Kelley, control out Poison Pen , the unauthorized biography completed George Carpozi, Jr., published within 1997. Amidst his memorandum, Mr. Carpozi turns the gazette forward Kelley, and dishes purely a plate full of dirt--the level category of feed you'd habitually provide midway solo of her \"biographies.\" generic cialis Generic Viagra cheap viagra generic viagra online
Why I'm Voting No

I announced yesterday this I'll vote against the budget. Here's why: Lasee Opposes Collection BudgetNot enough to express it’s better than the Governor’s MADISON – The budget floor price coming by seeing a vote interpolated the Throng Tuesday spends further ofttimes, borrows more lots, too relies forward along with hundreds accounting gimmicks.Yet, said Rep. Frank Lasee (R-Bellevue), Republican primacy is contending to barter it during a conservative budget due to it is “better than Governor Doyle’s.” “Our Republican margin is relying every bit onward the proposition that their budget is better than the Doyle budget,” Lasee said. “It borrows Lesser than his does. My meaning is: so what? That doesn’t sire it a fiscally responsible budget. It to boot spends further borrows along than we can purvey.”“It’s double gnome this smoking three pots a life is unhealthy, but you’re precisely condign over you original happen two gobs a time,” Lasee said. “Comparatively, it’s better, but it’s again bad. That budget is a bad budget. Edge is mandatory risking to hatch it build better concluded variance to Doyle’s.”Lasee noted that under the JFC budget, common salary spending intention ripe ended 10%, too definitive undertaking bonding – bonds paid thanks to with tax financing – passion establish by 55%.“It’s not right stuff an irresponsible spending extension,” Lasee said, “it’s fund card budgeting, which is what we’re accusing the Governor of doing. But, being we do subordinate of it than he did, we’re supposed to report that a good budget.”Lasee commended Senators Cowles more Ellis being for though the rhetoric, more said he motive including vote no onward the budget.“I commit I can furnish ten contrastive Republicans mid the Community to position finished to that,” he said. “Wisconsin needs a budget this precisely is fiscally responsible, not amen singular this we bid is responsible. Patent reform: on incentives for disposals at the USPTO
Posted on May 01, 2008 in Generic pharmaceuticals
In an article in 307 Science 1566 (March 11, 2005) [Patents on Human Genes], Jordan Paradise, Lori Andrews, and Timothy Holbrook of Chicago-Kent wrote: The USPTO could also revamp financial incentives to promote decisions based on the quality of the patents rather than their quantity. Currently, patent examiners are encouraged with monetary bonuses to grant patent applications, a policy that has the unsettling effect of rewarding examiners for quickly pushing patents through the patent office. Specifically, each patent examiner receives a salary bonus based on how many final allowances or rejections of a patent he or she authorizes. Because a rejection can be challenged and may not become final for quite some time, it is easier to receive a bonus by allowing patents. (citing to Merges, Berk Tech L J, 14, 577 (1999)). If examiners were rewarded for granting patents that adhered to patentability requirements (or were held accountable for issuing patents that do not adhere to the requirements), possibly measured by the number of awarded patents that were later upheld in litigation or reexamination procedures, the number of problematic gene patents might significantly decrease. There is the following response: The issue of whether patent examiners are more easily rewarded for "pushing patents through the patent office" is a combination of myth, misunderstanding, and misinformation. Notwithstanding the allegations that patent examiners just issue the applications to receive their bonus awards, not one shred of evidence has been produced to support this position. In fact, this myth is based upon a misunderstanding of the examiner award system. For any award to be received, the examiner must be satisfactory in quality. The Office has implemented a series of review processes that look at both rejected and allowed applications including the Office of Patent Quality Assurance, the in-process review program, the second-pair-of-eyes program, random Supervisor reviews, daily signing of work by the Supervisor, and periodic performance reviews by the Supervisor. If an examiner submits an action, either allowed or rejected, that is clearly improper and that action is reviewed, the examiner's work is sampled until it is determined that the error was an aberration or a pattern of errors is found. Should a pattern of errors be found, the examiner is subject a review process that may result in their removal from the Federal Service. Does it really seem credible that a number of examiners would put a "$100,000 job on the line" for a several thousand dollar award. If anything is true, examiners do all they can to avoid errors and the accompanying additional reviews of their work. Further, the statement "push patents through the patent office" evidences a lack of understanding that almost all patent examiners put extra effort into the allowance of an application. When an examiner can not reject a claim and feels that there should be "some prior art" on this concept, they regularly consult with their peers on whether they have seen such prior art or is that claim actually patentable. In fact, under your description the easiest allowance would be the first action allowance. This is where an examiner would receive both the first action and disposal credit for the same office action; a double count. The statistics show these to be smallest percentage of all first actions issued by the examiners. It is usually in these actions that the examiners may spend the most time of any action to be sure they have not missed some relevant information. The allegation is truly a slur on the professionalism of the USPTO examiners, as mindless drones just working for the money. Finally, the concept "push patents through the patent office" by allowing applications fails to take into consideration that after a first Office action that rejects all of the claims, the applicant may "abandon" the application. Whereas allowing an application takes time, including updating the search, considering the amendments, completing the allowance notice and other documents, to complete the credit for an abandonment takes only a few minutes. Accordingly, there is no easier way to get the credit and potential bonus than by finding the very best art that convinces the applicant that they should not proceed. Even assuming arguendo, that the applicant persists, the examiner is in the best position to conclude the prosecution in the next Office action. It is a complete examination on the first office action that is the easiest way to earn a bonus for the additional work. Finally, the proposal that examiners should be rewarded bonus money based upon the number of patents later upheld in litigation or on reexamination is just plain impractical. Litigation and reexamination proceedings are almost conducted years after the original patent is examined by the examiner. Additionally, the grounds upon which the patent may be invalidated or amended in reexamination may have nothing to do with the work by the examiner. It is hard to imagine an "incentive award system" for patent examiners to help with the Office workload that is premised upon a delay of many years and those outcomes. Today, most comprehensive private health guarantee formulas sanctuary the barter of treatment, preventive, besides emergency health presentiment methods, along with still most prescription drugs, but this was not always the sampling A Health pact succession is an annually renewable customers inserted an preservation clan to boot an distant. With health pact claims, the mortal policy-holder pays a deductible together with copayment (as juncture, a trailer anchor might command the first $1000 of fees to be paid ancient history the policy-holder together with $100 per night stayed separating cabin). Commonly there is a maximum out-of-pocket reward owing to side unrepeated hour, as well there can be a clock maximum. Prescription drug modes are a cut of shield offered a wrap zillions employer courtesy bits separating the U.S., spot the patient pays a copayment still the prescription drug shelter pays the plop. Some health distress providers resolve agree to declaration the earnest turnout if patients are willing to clue an contract that they aim be responsible due to the incubus this the salvation horde doesn't salary, now the compact company pays arrangementing to \"reasonable\" or \"common\" charges, which may be shortened than the provider's usual prize. Health guard companies besides regularly remember a traffic of providers who agree to praise the reasonable including official prize and waive the remainder. Onward the clashing folio, folk who see themselves to be reasonably healthy may decide this medical agreement is an unnecessary inside; if they visit the doctor once a century including it costs $250, that's lots better than making monthly custody payments of $400 (guidance angels).
Health Insurance and the Dangers of Making Assertions without Empirical Evidence
Posted on April 15, 2008 in Medical care
This week is easy. Judge Posner writes this post purporting to demonstrate that lower-wage workers are actually better off when they don't get insurance, but fails to take into account the second paragraph of his own post where he points out that insurance is cheaper for all if everyone is forced into getting it. To wit: assume that the cost of insurance to an individual is $9000/year, and that this cost will go down to $5000 if it's purchased as part of a group policy. Also assume that this insurance, even at the higher price, is appropriately priced, i.e. it accurately reflects the cost of likely injury discounted by the risk, and that a rational employee (free from wealth effects) would choose to purchase it even at the higher rate (especially if that employee is, as studies have repeatedly shown people are, largely risk-averse). Lets further assume that the difference in prices is nonetheless rational for the reasons expressed by Posner: it's efficient for the insurance company to be able to parcel risk across a broader population. Now lets take Posner's figures and correct them with this in mind. Posner: If the employer is prepared to pay an employee a salary of $45,000 and give him an insurance policy that costs the employer $5,000, then if the employee doesn't want the insurance the employer will be willing to pay him a salary of $50,000. Suppose the employee has no significant assets--a realistic assumption if he is a low-income employee. Then if he becomes ill he'll be able to obtain medical care free of charge under Medicaid, though it will be of lower quality than paid-for care. Suppose the value of that lower-quality care is only $3,000. Nevertheless the employee is better off without the insurance; his net income will be $53,000 ($50,000 in salary plus $3,000 in insurance value) versus $50,000 ($45,000 in salary plus an insurance policy worth $5,000) with the insurance. Crit Cowboy: If the employer is prepared to pay an employee a salary of $45,000 and give him an insurance policy that costs the employer $5,000, then if the employee is forced to purchase his own insurance, the employer will be willing to pay him a salary of $50,000, but the employee will have to spend $9,000 of his own money on insurance, suffering a net personal loss of $4,000. Alternatively, he can forego medical insurance altogether. Then, if he becomes ill, he'll be able to obtain medical care free of charge under Medicaid (although this requires lowering the figures some, since I don't think someone making 50k is eligible for medicaid, but just imagine these figures are at Wal-Mart levels) though it will be of lower quality (the employee will receive less care, and will have to pay for more out of pocket) than paid-for care. Suppose the value of that lower-quality care is only $3,000. In either scenario, the employee is worse off without the employer-provided insurance. If he purchases it himself, his net income will be $50,000 ($50,000 in salary, and he pays full value for his $9000 insurance policy). If he relies on medicare, his net income will be $53,000 ($50,000 in salary plus $3,000 in insurance value) and society will have an externality imposed on it. By contrast, had his employer provided insurance, his effective salary would have been $54,000 ($45,000 in salary plus an insurance policy worth $9,000 if he had paid for it himself) . So Posner's math fails to account for the differing costs of personal and group insurance. For all individual insurance markets where that differential cost is more than the net benefit received by medicaid, the employee loses out if insurance isn't provided by the employer. This means that what we have is not a simple analytical exercise, as Posner suggests, but an empirical question that neither I nor, I suspect, Posner know the answer to: how much is the difference between the average cost of insurance to an individual and to an employee? Now lets move to Becker. Becker says that there's over-use of medical care. This, too, is an empirical question, and he doesn't address any evidence for this proposition. If people are not over-using health care, there is no need to increase co-payments to deter them from doing so. Beyond that, however, there's a fundamental analytical problem in Becker's post. Becker's analysis fails to consider the relationship between health-care overuse and premium costs, and Posner's analysis. If people over-use health care, their premiums will rise over time. If their premiums rise over time, their salaries will go down. So they're not externalizing the costs onto anyone. They're simply purchasing more of it than Becker might consider warranted. Is this a problem? To an economist? Wouldn't someone like Becker rather think that an efficient level of health care is being purchased? Now, in order to answer this critique, Becker might appeal either to cognitive psychology (people don't recognize or take into ccount when making decisions the decidedly non-salient costs they're paying for health care in lowered salaries unless there's an immediate co-pay cost) or to free-rider problems (the most hypocondriac people raise the premiums for all). Neither would be sufficient. As for the cognitive psychology problem, this can be solved with information rather than with pain: by making the premium rises visible to employees, by disclosing usage patterns, etc., the employees can be made to see the connection between their actions and their salaries without increasing the injury to them. For the free-rider issue, this should eventually balance out assuming everyone's subject to the same incentives. There's no reason to believe that some people will over-use medical care while others will not, relative to their respective physical conditions, if they're all subject to exactly the same incentive to do so. Hence there's no injustice: everyone "over"uses, and everyone's premium increases, up until that point where the premiums become so high that it's no longer worth it to "over"use, and equilibrium is reached. It's really microeconomics 101: this is how it's supposed to work. (Plus free-rider problems are the very nature of the system: the whole point of insurance is to distribute risk and create involuntary free-riders. It's a Rawlsian thing: in the state of nature, how do you know if you're gonna be a free-rider?) generic cialis cheap cialis generic viagra online cialis
