Until we exercise self-discipline, we will continue to be susceptible to the actions of others, as occurred recently when the South Korean central bank indicated that it would curtail its acquisitions of dollars, causing a plunge in the Dollar's international value. Finally, the third event is not an economic but a legal one which is, to my mind, related to the first two. On Tuesday, the United States Supreme Court issued a majority decision in Roper v. Simmons which interpreted the U.S. Constitution, in part, based upon foreign laws and world opinions. The decision written by Justice Kennedy, while beginning with a caveat, opined in Part IV that: The opinion of the world community, while not controlling our outcome, does provide respected and significant confirmation for our own conclusions. Over time, from one generation to the next, the Constitution has come to earn the high respect and even, as Madison dared to hope, the veneration of the American people. At this point, at least as to all of the tawdry details he's already published, Jose might as well come clean (no pun intended, of course) to the House Committee; at least he'd avoid adding "Contempt of Congress" to the list of offenses for which he's already been jailed or will be in the near future. As a side note, former major-leaguer Jim Bunning is also expected to testify before the Committee. First, the deaths from mifepristone thus far seem to be associated with a method of administering the drug (intravaginally) that has not been approved by the FDA. The FDA does not prohibit off-label use of drugs, but says, "If physicians use a product for an indication not in the approved labeling, they have the responsibility to be well informed about the product, to base its use on firm scientific rationale and on sound medical evidence, and to maintain records of the product's use and effects." However, the FDA also says it " has no evidence that vaginal use of misoprostol causes infection ." Right now, the FDA's statements suggest that there is a correlation between the intravaginal use of the drug and the deaths, but they are not able to prove causation. So, what information led prescribers to use the drug intra-vaginally? Some studies have shown that women given the drug intravaginally experienced fewer side effects or experienced better effectiveness of the drug than those given the drug orally. Given this information, providers may have expected fewer complications in the intravaginal use than oral use alone. Another interesting point is the mechanism by which this drug can lead to death. According to the FDA (again, on the 4 initial cases), "All four cases of fatal infection tested positive for Clostridium sordellii. In addition, FDA tested drug from manufacturing lots of mifepristone and misoprostol and found no contamination with Clostridium sordellii." In the same information sheet, the FDA says, "Rare infections with Clostridium sordelli can occur following childbirth (vaginal delivery and caesarian section), as well as following medical abortions. We can talk all we want about setting targets for universal access to treatment by 2010 and then we will move the goal post yet again when we fail. I do not know anyone who really believes these goals are attainable particularly given what, if any, health care infrastructure in place in the countries most afflicted. There will be a lot of talk in Toronto about health care workers and a fair amount will undoubtedly be focused on community-based solutions. To fight HIV/AIDS and OIs will require every resource in our arsenal, but to substitute donor supported community-based solutions thereby letting national governments off the hook is unsustainable and irresponsible . There are no substitutes for proper health care, every resource is needed. For national governments to fail to provide even the most basic protections for public health care providers is unacceptable. For donors to support community-based programs that cannot do the same is unacceptable. Health care providers whether public or private are a front line of defense and they must be protected. Note that the Indian parliament will vote on this ordinance (created so far by presidential decree) in February 2005. The change which goes into effect on Jan. 1, 2005 is not final until the parliament votes, so that writing editorial criticism of the ordinance could impact the final version of the law. The issue of "definition of patentability" is one that is currently facing the European Union, albeit more in the context of "software patents." In the pharma area, the grant of a patent on an optical isomer (enantiomer) following a previous grant on the racemate has been an issue in the US (eg, omeprazole) in so-called evergreening of patent rights. Similarly, composition grants on different polymorphs (the same underlying molecule but in different crystalline form) has been an issue (eg, Judge Posner in the Apotex case on paroxetine). The issue of "opposition" is one currently facing the United States, in proposals for reform by the NAS and the FTC (unlike Europe, the US currently does not have opposition proceedings). Mr. Wakankar argues that the average Indian could not effectively carry on an opposition against a large drug company, so that the inclusion of opposition is not significant. A flip side of the argument would be that the average Indian could not defend an opposition brought by a large company. Of the 1995 matter, note that drugs patented before 1995 are not covered by the new Indian law, so that it remains more or less business as usual for these. Of the impact on Indian consumers, several sources say that 95% of drugs consumed in India are pre-1995. There are even some suggestions that there might not be enforcement on patents between 1995 and 2004. Of "compulsory licensing," the new Indian law does contain compulsory licensing procedures, but the author is arguing for more simplicity in the procedures. Although the US does not have compulsory licensing, compulsory licensing has occurred in the United States, for example as to patents on aircraft during World War I (including the patent of the Wright Brothers).
