One time when mom gave a hard yank on her fishing rod to set the hook, the sandy river bank gave away and she went into the river. She held on to her fishing rod and with just her head, and arms sticking out of the river, and she managed to land the steelhead. Mom loved gardening and grew every kind of vegetable and berries. She made jams and jellys to put on her delicious homemade bread and buns. Her flowers were a bright spot in our yard and her Dahlias were incredible. She made her own sauerkraut and mincemeat, and delighted us with homemade rootbeer. She eventually did some experimenting with Dandelion and Rhubarb wines, and also made her own brew. :) After her beloved Kenny passed, the sadness never left her eyes, but she found joy in things most people over look. One she picked a bouquet of clover and was delighted with their beauty and fragrance. Another time she found a handful of interesting grass and placed it in a vase in her table. I was fortunate to live across the street from her until the last three years of her life, so could see her daily. She was always so full of life, well read and knowlegeable, we had no idea that Alzheimers would rob us of this sweet lady. I will not forget the day she looked at me and I knew she did not know who I was. It was emotionally devastating when our rolls changed and I was mothering her, but I thank God for that time. Eventually there was no recognition at all, just the blank stare. But I could make her laugh and it was her laugh that kept me strong. It was the one thing about her that did not change. She lived with me the month of March in 2001. Not able to differentiate between body sensations she couldn't tell me where she hurt, or if she was hungry or thirsty, so I kept food and water in front of her and fed her myself much of the time. One day my granddaugter came to visit with her children. Her oldest was three and always asked me to put lipstick on her. This day she asked her Great-Great Grandma if she wanted some too. Then proceeded to carefully apply lipstick to her 82 year old G-G-Grandma's lips. This is one of the last pictures I have of my mother. She left us on June 26, 2001, three months after this picture was taken. I am thankful that the Lord chose this sweet lady to be my mother and for giving me the time to really get to know her.

How was your Turkey Day weekend? Eat too much? Get indigestion from watching the Cowboys stomp Tampa? What about Black Friday? Who has their Christmas shopping done? Did you see anyone die crashing into a big tv on sale at Wal-Mart? For me Thanksgiving weekend went smoothly. I went to my aunt and uncle's home near Green Bay last Thursday. We ate plenty of turkey, drank a little wine, and took an entire pumpkin pie home--that lasted only one day. After pouring through the ads I didn't find anything to get me out on Black Friday. Instead, I slept late and watched whatever college sporting event was on tv. Saturday was off to my aunt and uncle who live near New London for another turkey meal. The highlights there were meeting my cousin's girlfriend and tossing beanbags outside because the weather was so nice. Sunday was football even though the Packers weren't playing. The Patriots beating the Bears made up for my bad fantasy football showings. My Thanksgiving weekend turned out well. I kicked back with the family and ended up not eating too much.

Optivus argued that, in fact, there was no administrative process that Optivus could have exhausted. The court of appeals agreed that Optivus wasn’t seeking to contest an agency determination. Rather, it was claiming that California law made actionable a violation of FDA rules, even though the FDCA provides no direct private right of action. Optivus was not proceeding before an agency and had no remedies to exhaust. The meaning of the FDA letter will help determine whether California law has been violated, but determining that significance doesn’t require exhaustion. Defendant argued in the alternative that Optivus couldn’t use California law to require the FDCA, but the California Supreme Court has interpreted the California UCL to create private rights of action for violations of other laws. Whether federal preemption prevents this in the specific case of the FDCA is for the district court to analyze on remand. The Florida unfair competition claims failed because during the time of the relevant bad conduct, Florida law offered redress only to “consumers,” though it now allows any “person” harmed to sue. Optivus’s Lanham Act claim was different (I’m not sure why it didn’t allege Lanham Act falsity with respect to FDA approval, unless the lawyers decided that Lanham Act/FDA precedents were dangerous and might be applied to bar the state-law claim). Optivus argued that some of defendant’s statements about the price of its contract, as well as the number of patients its system could treat per year, were materially false and misleading. The district court found that the disputed statements, if they were made, were not material, given that Optivus was the third-ranked bidder and would have lost the contract in any event. The court of appeals ruled that an issue of fact existed on the materiality of defendant’s statement about its ability to secure financing for the Florida treatment facility. Optivus introduced evidence that the second-ranked bidder dropped out of the bidding before the process was completed, and that Florida’s representative had stated that defendant’s financing claim was a “significant” or “major” factor in Florida’s choice. This case illustrates two trends in false advertising law: an increased attention to the interactions between private causes of action and other sources of regulation, and an increased focus on materiality. Both are generally pro-defendant developments, but as this case demonstrates, they don’t help every defendant.

Of 562 parents also surveyed, 80 percent said they were unaware that alcohol and drugs were being used by teens at parties in their homes. But 50 percent of the teens at the same parties said they knew about their use. "That shows just how out of touch the parents are," Joseph A. Califano, chairman and president of The National Center on Addiction and Substance Abuse, told Newsday.
