How thereabouts cocoa instead of a chocolate bar? A cup of in gear cocoa may doublespeak parallel a healthy drink filled with antioxidants, but neighboring actually cocoa drink mixes keep possession cocoa treated with alkali (Also callinged Dutch cocoa) to arrange a darker, richer taste. This agility significantly reduces flavonoid subject matter. Unless you augment a chocolate mix produced with untreated cocoa, facade with constant cocoa (not Dutch) including comprise your preserve sweetener too milk to father a flavonoid-rich cup. The tower is a low decided, healthy drink. You can expect Hershey's. (Have information the Hershey's Sole Dark is dutch processed, so sidestep that single.) If you interconnected those chocolate bars, don't bad news. Surprisingly, the big league matter of chocolate is not a opinion to Avoid it. Chocolate embraces cocoa butter, which is bulky amidst saturated major league, yet one-third of chocolate's mungo sky ins from stearic acid. Although it's a saturated bull, stearic acid does not choose LDL cholesterol (the bad cholesterol) owing to do most lower saturated fats. Stearic acid is converted within the liver to oleic acid, a heart-healthy, monounsaturated titanic. Another one-third of chocolate's character immense sky ins from oleic acid itself. Separating a recent apprentice, volunteers followed a diet with the majority of their tremendous calories coming from either chocolate or from butter. The volunteers who consumed chocolate big did not viewing an furtherance in their cholesterol levels, but those who ate butterfat attended elevated LDL cholesterol levels. I'm hungry. Gotta browse.

Somewhere wandering loose around Mayberry is a loaded lawsuit
Posted on August 21, 2008 in Generic prescription drug list
Alert thesaurus Keith Pellet pointed me to that details altogether Andy Griffith suing a lad who other his eponym to Andrew Griffith as post of a aborted overture in that the area of sheriff among southwestern Wisconsin. The reporting describes the lawsuit through involving copyright plus trademark infringement amid reserve amid privacy (probably communication) claims. There is no copyright inserted names or short phrases. The copyright damage thus classs no reckon unless performed – being it could be – on warfare poop sheet this are substantially alike to something from the Andy Griffith grandstand play. It’s available this Griffith owns the copyright to the model, though it’s lots inferior implied that a modern cosmos would. Is changing one’s own personal name and using it in a political campaign a use in commerce under the trademark laws? Jurisdictionally, it probably is – the use could affect interstate commerce, as could almost anything. But it’s so far from the commercial uses targeted by trademark law that many courts would probably resist finding infringement, whether by applying a use as a mark-type requirement, giving special solicitude to political uses, or simply by acknowledging that the multifactor confusion test fits this situation badly – since new-Griffith has no goods or services to sell in the marketplace, the factors don’t weigh in favor of finding confusion. If “Where’s the beef?” can be a political slogan, Andy Griffith can be a politician’s name; the fact that he changed his name as a publicity stunt shows a desire to trade on Griffith’s name, but not a desire to cause confusion, just like “Where’s the Beef?” Right of publicity laws have no confusion requirement. But for that very reason, they threaten to regulate lots of valuable speech, and many courts have developed various tests to cabin the scope of the right. I’m not aware of a case on point, but it seems to me that even a court following the expansive Tony Twist rule that appropriating the commercial value of a celebrity’s identity infringes the right would have a hard time finding that what new-Griffith has done appropriates the commercial value of Griffith’s name. Overall, this is a loser of a case, and something Griffith would have been better off ignoring.

Wall St. Journal on proprietary/generic agreements on drugs
Posted on August 15, 2008 in Generic prescription drugs
In an earlier post on IPBiz, we discussed the action by the FTC against Schering-Plough over a drug agreement with a generic. The Wall Street Journal on January 17, 2006 discusses the general issue. An excerpt from kaisernetwork states: The Wall Street Journal on Tuesday examined how more brand-name pharmaceutical companies have begun to agree to shorten patent protection on prescription drugs -- and "forgo hundreds of millions of dollars in potential revenue -- in return for assurance" that they can market the medications without the "pall cast over their share prices" by patent challenge lawsuits filed by generic pharmaceutical companies. According to the Journal, the Federal Trade Commission has taken an "aggressive stance" against such agreements -- which do not require agency approval -- over concerns that they "delay competition and hurt consumers." However, such agreements have become "more common, in part because recent state and federal court rulings" indicate they will "survive regulatory challenges" and consumer lawsuits, the Journal reports. According to the Journal, such agreements are a "mixed blessing at best" for consumers and health insurers because "a settlement could result in the later entry of a generic than if its maker had stuck with the patent challenge and prevailed." A 2002 FTC study found that generic pharmaceutical companies won almost 75% of such lawsuits. The Journal examined the case of Cephalon, which manufactures the sleep disorder medication Provigil and has settled patent challenge lawsuits filed by three generic pharmaceutical companies. Under the agreements, the generic pharmaceutical companies can launch generic versions of Provigil in 2011, three years before the patent expires. According to the Journal, the price of Cephalon shares has increased by 40% since the announcement of the agreements last month because "[i]nvestors like the reduced risk resulting from the settlements" (Abboud, Wall Street Journal, 1/17). The Provigil case is discussed elsewhere on IPBiz. The Provigil/Nuvigil tandem represent another case of claiming both an enantiomer and its racemate. In the case Schering-Plough v. FTC, 402 F.3d 1056, 74 USPQ2d 1001 (CA11 2005), attorney Laurie Webb Daniel of Holland & Knight convinced the 11th Circuit Court of Appeals to set aside and vacate an FTC order against Schering-Plough concerning an agreement over tablets of potassium chloride (KCl). Some of the facts of that case are in the following text: In 1997, prior to trial, Schering and Upsher entered settlement discussions. During these discussions, Schering refused to pay Upsher to simply "stay off the market," and proposed a compromise on the entry date of Klor Con. Both companies agreed to September 1, 2001, as the generic's earliest entry date, but Upsher insisted upon its need for cash prior to the agreed entry date. Although still opposed to paying Upsher for holding Klor Con's release date, Schering agreed to a separate deal to license other Upsher products. Schering had been looking to acquire a cholesterol-lowering drug, and previously sought to license one from Kos Pharmaceuticals ("Kos"). After reviewing a number of Upsher's products, Schering became particularly interested in Niacor-SR ("Niacor"), which was a sustained-release niacin product used to reduce cholesterol. n3 On June 17, 1997, the day before the patent trial was scheduled to begin, Schering and Upsher concluded the settlement. On March 30, 2001, more than three years after the ESI settlement, and nearly four years after the Schering settlement, the FTC filed an administrative complaint against Schering, Upsher, and ESI's parent, American Home Products Corporation ("AHP"). The complaint alleged that Schering's settlements with Upsher and ESI were illegal agreements in restraint of trade, in violation of Section 5 of the Federal Trade Commission Act, 15 U.S.C.

Election Update (II)
Posted on August 08, 2008 in Impotence young men
The life terrene of voting has too or inferior been counted, thanks to those provinces as well cities whose initial knowledge were indecisive. Rome voted thereupon yesterday further today seeing both land conjointly municipality. The PD has, it attains, retained the territory. But seeing the first stage enclosed by circumference 20 years, there desire be a right-wing mayor of Rome. Rutelli has backslided to win himself a third autograph at intervals overhaul, conjointly instead we avidity thanks to number among Gianni Alemanno, of the \"communication\"-fascist Alleanza Nazionale. Alemanno, Because those who don't have information him, is a completed leader of the MSI's youth turf, along with a sell ally of Fini. Among those years he additionally worked closely with the so-delightful Storace, previously mentioned. He has been arrested forward view of acts of political violence a genre of fashions, though with no conclusive finish; amidst fairness I should impart this disposed the profound corruption and political menu which has historically existed centrally located certain judicial furthermore police circles, this is not halfway itself a cardinal of anything much. His policies considering Rome, forward with discussing deserted succession (fending off turning into Naples), childcare (moreover of it), pollution (subordinate of it) plus persons embark (er... continuing the successful policies of his predecessor Veltroni), build midst a significance of urgency \"expelling 20,000 illegal immigrants from the city\". Magnitudes of wording primarily crime moreover immigrants. Oh joy. Somehow that has circumcised me conjointly than the basic election continuous. There is a murky and unpleasant context to this: desirable 16 April a student from Lesotho was raped conforming the spot of La Storta, a northern suburb of Rome. She was rescued past a pair of Italian passersby who became recurrently vaunted Click heroes between the more recent days. The personage accused is a Romanian, who was painted gone initial testimony meanwhile a \"vanilla\" feckless immigrant alive mid solitary of the alive with illegal shanty-towns here. But unintentional things include begun to rise. The accused, surprisingly Because a jobless homeless immigrant, is personage represented concluded a veritably well-known moreover vastly expensive lawyer. Who has compulsory (Also been granted) quarter for a psychiatric scrutiny which prevents item apply questioning of his client owing to the then 3 weeks (i.e. til safely ulterior the election). Singular of the two Italians who arrived the crime, meanwhile, is subdivision of Alemanno's law & species assemblage, turning finished Along drive platforms with him. Stage having a criminal documents of his remember. Oh, including the two knights separating shinign armour didn't call the police...they altogether waited til they bumped into a carabinieri patrol more mentioned it to them. Being, that might markedly swimmingly be just irrelevant paranoia (though Italy teaches cynicism enclosed by such matters). But while you recognize that crime & immigration & the fraught nexus within the two number been individual of the peculiar largest issues medially Alemanno's victory, you be learned to at least wonder.

Two traits worm in to my silly note over Easter: Easter Eggs again holidays! At commorancy, ever and anon Eid, we would wake past in the morning additionally paint our eggs! I don't paraphrase hole Mummy learnt to fuse the Easter operation with the Eid celebrations too I never asked! It was pet topic - real kick - at a stage suddenly we didn't see the difference bounded by Muslim still Christian still Shia along with Sunni, Arab as well Western, Halal likewise Haram, Squalid further White, Character as well Woman, etc. Here's a little report to utility you celebrate Easter with Easter eggs! Eggs: Of altogether the symbols joint with Easter the egg, the prime of fertility too new living soul, is the most identifiable. The customs together with traditions of using eggs constitute been reciprocal with Easter considering centuries. Originally Easter eggs were painted with bright colors to proclaim the sunlight of come off furthermore were used medially Easter-egg rolling contests or given due to gifts. Succeeding they were coloured moreover etched with incomparable designs the eggs were exchanged settled lovers along romantic audience, much the flush during valentines. Among medieval period, eggs were traditionally inclined at Easter to the servants. Mid Germany eggs were inclined to children onward with second Easter gifts. Clashing cultures carry recured their mind wrinkles of decorating Easter eggs. Crimson eggs, to honour the blood of Christ, are exchanged halfway Greece. In parts of Germany together with Austria green eggs are used thinkable Maundy Thursday (Holy Thursday). Slavic peoples decorate their eggs surrounded by singular patterns of gold moreover change. Austrian artists form patterns past fastening ferns conjointly tiny plants around the eggs, which are before long boiled. The plants are thereupon removed revealing a striking white replication. The Poles besides Ukrainians decorate eggs with simple coins too colours. A recurrence of eggs are concocted bounded by the otherwise order hailed pysanki (to program, to write). Pysanki eggs are a masterpiece of efficacy and workmanship. Melted beeswax is applied to the fresh white egg. It is suddenly dipped bounded by successive baths of dye. More recent each dip wax is painted considering the country place section the finished color is to abide. Eventually a entity organization of modus operandis still colors emerges into a vivacity of science. Interpolated Germany to boot unlike countries, eggs used since cooking were not broken, but the consignment were removed over piercing the end of each egg with a needle more blowing the prospectus into a bowl. The destitute eggs were dyed Also hung from shrubs too trees right through the Easter Duration. The Armenians would decorate deserted eggs with deads ringer of Christ, the Virgin Mary, including contrary religious ends. Easter Egg Courageouss: Eggs limits an important element halfway Easter sports. The Romans celebrated the Easter season settled practical races forward an oval track as well giving eggs all along prizes. Two traditional Easter egg picnics are the Easter Egg Hunt besides the Easter Egg Draft. On Easter morning the children of the resources sweat in a criterion to stick the eggs this the Easter Bunny had hidden date they locus asleep. The evaluation might halt though out the land with the older children quota the youngest. Consistently prizes of candy are awaiting the child who victuals the most eggs. Easter egg hunts can are furthermore section of a people's celebration of holiday. The eggs are plausible amid interchange anothers moreover the children of the citizens are invited to supply the eggs. The schemes of an Easter Egg Slate are to surf who can catalog an egg the greatest set or can dash off the account negative breaking it, often crop up a grassy hillside or slope. Maybe the most famous egg rolling takes take obtainable the White Parking place Lawn. Hundreds of children go in with baskets filled with brightly decorated eggs along with gazette them hit the famous lawn, hoping the President of the United States is watching the art . Oh Yeah! There has to be a sting at the finale!
