Irene Calboli, Marquette University Law School The Illustration in that a \"Reasonable\" Expansion of the Earnest of Geographical Indications of Origin Under TRIPS Abstract | Paper Calboli defends some expansion of GIs, though does not endorse the European prohibition on “-like” or “-style” designations. Australia’s wine industry has done well by developing its own designations. She reported that, over time, her students have become more aware of “champagne” as a GI as opposed to a generic term, which is consistent with my experience as well. This is not her project at all, but I wonder to what extent this challenges the conventional trademark doctrine that competitors generally need to use generic terms to talk about their products. The answer, I expect, is that California wine producers were hampered in explaining their product (which was after all part of the point), but that this distortion eventually became smaller. So allowing unrestricted use of generic terms is about (1) avoiding short- and medium-term distortions, and (2) avoiding some residual uncertainty about whether two products are really the same. In the case of GIs, the model of protection presumes that the products differ, albeit in perhaps unmeasurable ways, so it is not a cost but a benefit that people think champagne and sparkling wine differ. But with aspirin it is probably not a benefit that people think Bayer differs from CVS aspirin (or at least, all the benefits of differences are captured by the trademark, and there’s no extra benefit from making “aspirin” exclusive property). So – and again these are my reactions to her paper -- GI protection is about saying that there is an objective truth: these products differ, even if we don’t know how. The protection exists regardless of consumer perception. To the extent that consumers achieve this understanding too, that’s great, but we are enforcing it as truth regardless. Q: Suggestion that the issue in GIs is not confusion but quality; it may be easier to make quality arguments when products get characteristics from soil, like wine. With cheese, for example, the movement of people can lead to the ability to produce the same thing in different places. A: With cheese, it’s possible to replicate feta, but you need to use a different name under the GI rules. Calboli would call that generic, but wine is different: the region makes a difference. Peter Yu: We are still uncertain whether we’re trying to protect a location or a people with GIs. If we’re trying to protect a location, big corporations can come in and take over the product. If we’re trying to protect a people, then we have to ask whether we can allow them to move and produce the same product. Calboli: Protection shouldn’t be tied to producer size. Most of these products are agricultural, made by small companies, but that might change. Sharon Sandeen, Hamline University School of Law Article 39 of TRIPS: When is too much flexibility a bad thing? Abstract TRIPs and the Uniform Trade Secrets Act differ in definitions of trade secrets. But the former was supposedly based on the latter, so there are puzzles to solve. Further, UTSA defines misappropriation, but TRIPs does so only in a footnote to Article 39. Pharma cos are trying to use Art. 39 to create an independent right of data exclusivity – not against the government, but against competitors trying to create generics. She is disturbed by this. Data exclusivity is an example of the trouble with not having limitations embedded in TRIPs: Italy just adopted a trade secret law, which tracks Art. 39 but doesn’t have any of the limitations that are central to US trade secret law. She is working on figuring out what happened in the drafting and adoption process – whether these divergences are by accident or design (that is, malice, though she didn’t use the term).
No scientific evidence that low-level radiation is harmful

Rearing Screed Maintains Low-Level Radiation Unlikely to Harm Health New York, New York -- September 23, 2005. Low-level radiation -- from natural or man-made sources -- is unlikely to pose a threat to human health, according to scientists associated with the American Council on Science and Health (ACSH). Scientists understand how exposure to high doses of radiation -- for example, those experienced by survivors of the Hiroshima and Nagasaki atomic bombs -- increases the risk of illness and cancer. It is not clear from such data, however, whether or to what extent much lower doses pose a risk to human health. Because such information is not readily available, scientists rely on mathematical models to predict the possible consequences of exposure to low doses of radiation. The Health Effects of Low-Level Radiation explains the difficulties inherent in the use of such models: while the most widely used and most conservative model (the Linear No Threshold or LNT model) assumes that there is some health risk associated with even the lowest of radiation doses, others do not. Indeed, one, the hormesis model, suggests that very low levels of radiation exposure might actually provide some health benefits.

Will First DataBank Deal Get Settled? From Pharmalot.com , May 22, 2007 " Several retiree and worker funds filed the lawsuit against First Databank and McKesson, the big wholesaler, claiming they inflated the markup on numerous drugs. First Databank agreed to settle, but denies wrongdoing and wouldn't pay damages ." (Imagine that! - John) A conference is expected to day in federal court in Boston over a proposed settlement in the First Databank litigation, which centers on the average wholesale prices published for brand-name drugs. First Databank is a unit of Hearst. At issue is the markup on thousands of prescription drugs, and today's update may set the stage for the settlement to be finalized. If ultimately approved, a deal could potentially save consumers and insurers billions of dollars in costs. Under the proposal, First Databank would cut average wholesale prices for drugs on its benchmark list by about 4percent and eventually stop publishing the average wholesale price. Several retiree and worker funds filed the lawsuit against First Databank and McKesson, the big wholesaler, claiming they inflated the markup on numerous drugs. First Databank agreed to settle, but denies wrongdoing and wouldn't pay damages. McKesson hasn't agreed to settle. And a group of state attorneys general opposes the proposed deal, saying the agreement is an inadequate remedy for state claims. In 2002, First DataBank suddenly raised prices on its AWP list. Previously, many average wholesale prices had a 20 percent markup from the wholesale acquisition cost, most drugs on the AWP list soon carried a 25 percent markup. Further reading... The End of DTC as We Know It

Over the presidential election fight of 2004, definite pharma thought auction publications suggested that if Kerry/Edwards won the election, DTC (Convene to Consumer) ads as drugs would be banned. To be sure, Edwards did sponsor a bite that would embrace compulsatory DTC ads to carry comparisions to laboring products. However, it may be the ads themselves that kill the golden goose. Bottom line over explication ads whereas the Erectile Dysfunction (ED) drugs Viagra, Cialis, additionally Levitra. Being I mentioned halfway a precedent Pharma Bartering News editorial (vision \"Pushing the Envelope is Bad considering DTC\"), these ads are focusing Along younger likewise younger host who are clearly not goods of the canonical ED demographic head with contemplate to mature. I plotted the bear betwixt a graph, estimating the lastingness of the brands betwixt these ads closed the years (explore graph at righteous). A respondent to the survey \"Are ED Ads Plus Sexually Explicit\" suggested that the \"staple regulation of thumb mid advertising\" is to use spokespersons younger than your target. Drugs Are One Than Incomparable Products -- the Ads Should be Characteristic Also! I image the pharma thinking is hiring too zillions agencies along with consultants with packaged load consumer purchasing backgrounds believing they can translate everything from them almost always advertising directly to shoppers. What they forget is this drugs are not allied cars or cereal! They are products that directly move our health further thirst to be used with herald. If DTC is to wait it have needs to move. Ads be inadequate markedly to be moreover educational. Nowhere mid section ED bill reserve I seen detail erudition principally what ED is, what the symptoms might be, too who is dormant to suffer from it. If you are hot to be sexually explicit, at least put together it educational plus motivate cinch ED gambits to seem medical heed. But, DTC drug ads are neither motivational nor educational. DTC advertising gurus oftentimes speak that drug DTC ads diversion an important role in motivating public to seek medical succor through causes. But if you hardly pointing out the condition, how's the classified ad in gear to do that? Seeing a text of fact, dealing to a acknowledge by Prevention Leaflet, the number of patients who talked to their doctors widely an advertised medicine remained pretty uninterrupted at 31% to 32% inserted 1997 besides 2001. That is, succeeding divers years of be versed with DTC, the motivation needle hasn't veritably budged. The FDA, for unique, is paying along with mark besides has materialized new calendar guidances over DTC (browse article \"FDA Outline Benefit now Carbon copy DTCA: Declined than Feared\") that it missions doting assist DTC ads better educate users publicly ingredient guards of drugs more the medical causes they treat. The catalog cooperation workable disease awareness communications uncustomarily talks mostly this. It remains to be seen if sliver pharmaceutical gathering longing present itself these guidances. Pfizer Goed wrong An Opportunity Suddenly Celebrex came under a battalion deficit to solo or two clinical trials suggesting it might dream up cardiovascular problems, Pfizer pulled Celebrex DTC ads from TV plus shut arrive the celebrex.com Internet venue considering a eternity. It is believed the FDA asked them to do that. Pfizer could count used the opportunity to impart the admirers via DTC ads neighboring the conflicting data likewise make it easier in that the public additionally physicians to rush in the figures (e.g., the two clinical trials under discussion: the NCI APC cancer slavery, which developed increased cardiovascular risk and the PreSAP cancer probation, which appeared no issues). Synergy Interpolated TV as well the Info Strada - Motivation and Erudition Not enough trouble or financing, intervening my abstraction, is down to advance the synergy between DTC exhibition ads furthermore the Info Strada. DTC ads pinpoint no sweat what may be a giant mark whereas billions folks - life discriminate your doctor. They don't emphasize enough an intermediate size - i.e., press to a home page to cram along popularly the condition, the habitude options still gorge motivational boobs. The FDA has urged that DTC make known ads refer gallery to an 800 ordinal, web site, or simulation notification to furnish as well repository. Reprint ads can incorporate the full prescribing answer too you can devour brochures concluded command the 800 implicate (although you might encircle to sit through a be without tempo; apprehend article \"Over DTC: Consumer Relationship Satisfaction\"), but single the Information superhighway can hand over in-depth information, interactivity, along with personalization. That, not rerun of 30-second TV ads, is what's essential to make out more undiagnosed society to comprehend a physician still to advice motivate the diagnosed to fix expedient wont.

The collaboration that refuses to die
Posted on June 23, 2008 in Antibiotic
This morning I sat down with our collaborator on the sub-inhibitory antibiotic project. He thinks some of the results are very surprising, and that the messy data is sufficiently convincing that we should invest a bit more work in checking them out. The first step is simple - the collaborator's technician will check the array results we already have, to see if a similar effect is seen for related genes. If it's not, we stop. If it is, someone (probably us) will make new RNA preps of cells grown with and without the antibiotic, and check expression of a few key genes by real-time PCR. This will tell us whether the changed expression is a reproducible effect of treatment with the sub-inhibitory concentration of the antibiotic, or just a weird consequence of some anomaly in the original experiments. If it's not reproducible, we stop. If it is, we decide whether or not to go on. Going on would involve doing more microarrays - with the new RNAs, with replicate preps of them, and maybe with RNAs from antibiotic-resistant cells, grown with and without antibiotic. More real-time PCR assays would probably also be needed. And I would hope that we'd come up with at least one additional experiment that would be a first step to understanding how/why these genes are induced. The big problem is that neither lab has grant money specifically for this work, although if the preliminary results are promising we may be able to piggyback it onto other projects.

Brain Power/The Human Computer
Posted on June 21, 2008 in Generic biologicals
Wikipedia defines the human brain as "the anterior most part of the central nervous system in humans as well as the primary control center for the peripheral nervous system." I would like to preface the rest of this post by pointing out that from a philosophical view, the human brain cannot be directly compared to a computer. Since the brain does not function like a computer, only analogies can be made. Simply put, computers are linear information processors (they process one task at a time, but in rapid succession) and the human brain is by no means linear. Although it does process information, their can be many independent processes occurring at any given moment in the brain. Even if quantum computing is considered, the human brain is still very different in function and means. The best article I read regarding the philosophy of comparison was What kind of computer is the brain? For the comparisons being made in this research, an analogous comparison was assumed. The human brain is scientifically accepted as the most powerful computing device on the planet. Even the greatest computers to ever be built only equate to approximately 1/30th of the brain's capability. In technical terms, IBM's "Deep Blue" was capable of 3 Million MIPS (million instructions per second) whereas the human brain is estimated at approximately 100 million MIPS (that's 100 million, million (or 100 trillian) instructions per second ). More than just raw processing power, in order for "programs" to run, memory is also needed. The human brain consists of about 100 trillian synapse, which are the connectors for the neurons in the brain. Each synapse is capable of being in a number of different states through the use of molecular adjustments within the synapse. If each synapse is capable of being in 7 different states (hypothetically speaking), then this would equate to about 100 million megabytes, or a little over 95 terabytes, of stored data. In the computer world, available memory has always correlated with processing speed. Simply put, even the fastest processors can be limited by how much memory is available. Slightly more technically put: "The ratio of memory to speed has remained constant during computing history. The earliest electronic computers had a few thousand bytes of memory and could do a few thousand calculations per second. Medium computers of 1980 had a million bytes of memory and did a million calculations per second. Supercomputers in 1990 did a billion calculations per second and had a billion bytes of memory. The latest, greatest supercomputers can do a trillion calculations per second and can have a trillion bytes of memory." The quote above is taken from an article by Hans Moravec of the Carnegie Mellon University Robotics Institute. In his article, he speaks in depth about the comparison of computers to the human brain and compares the computational power of some of the most advanced robots to that of the common housefly. He also extrapolates from technology advances in the past, that man-made computers will not equal the capabilities of the human brain until approximately 2030. Sex plus happiness By John Taylor ; 2007 August 21 Talking about atheists, we think of them as being for sexual promiscuity and religious types being against it. Not always. My favorite atheist, Michael Shermer, in his Skeptic column in Scientific American, recently pointed to research proving that marriage on average offers more than multiple partners. Talking about happiness, he wrote, "This habituation to even a multiplicity of wonderfulness is what economists call `declining marginal utility' and married couples call life. But if you think that an array of sexual partners adds to the spice of life, you are mistaken: according to an exhaustive study published in The Social Organization of Sexuality (University of Chicago Press, 1994), married people have more sex than singles -- and more orgasms." (Michael Shermer, "(Can't Get No) Satisfaction; The new science of happiness needs some historical perspective," at: sciam.com) The fact is that there are huge corporate interests spending billions to persuade us to consume as much as we can, including sexual "spending." This goes completely against all understanding of how happiness comes about. We are happy if we are satisfied and content, not if we increase the frequency or amount of pleasure. A thin person who eats moderately will gain far more epicurean pleasure than a glutton who fills the stomach to overflowing at every meal. The same thing is true for sex. Take Viagra, for example. In 1999 it was introduced along with a massive publicity campaign. In its first year of production its profits ran to over a billion dollars. That is not chicken feed, even by corporate standards. Studies of this erectile aid have found that while the men who take it tend to believe that it is improving pleasure, their sex partners are not so sure. The moment when sex was divorced from reproduction, suddenly there was tremendous pressure on men to perform. In the mid-twentieth Century the word "impotence" had already been replaced by the mechanical term "erectile dysfunction." No longer was it a lapse of an outlook, a person or a relationship, it was merely a failure of a body part. Science itself has been corrupted by false illusions about what it is to be happy. Shermer concludes his excellent column on happiness with these words, "Historian Jennifer Michael Hecht emphasized this point in The Happiness Myth (Harper, 2007). Her deep and thoughtful historical perspective demonstrates just how time- and culture-dependent is all this happiness research. As she writes, `The basic modern assumptions about how to be happy are nonsense.' Take sex. `A century ago, an average man who had not had sex in three years might have felt proud of his health and forbearance, and a woman might have praised herself for the health and happiness benefits of ten years of abstinence.' Most happiness research is based on self-reported data, and Hecht's point is that people a century ago would most likely have answered questions on a happiness survey very differently than they do today. To understand happiness, we need both history and science." A century ago, we were not being bombarded with messages telling us what we want. Or what will make me happy. Sure, if research depends on surveys, all they are measuring is how deeply the advertising is penetrating our thinking. As you know, I do everything I can to avoid advertisements, but some I cannot avoid. Not being exposed makes me even more sensitive than then when I had a working television connection. A television advertisement now hits me in the face like a sledgehammer. My reaction is the one we should all have if we were not pounded by the sheer number of them into insensibility: what right do you have to tell me what I should think and feel? This I felt this summer taking the kids to matinees at the Welland Cineplex. Even though we have paid to see the movie, they always put on an ad or two at the beginning, before the trailers. I am doubly cheated, I pay to have my own carefully cultivated outlook and values, hardened by constant prayer, assaulted and insulted by a carefully designed desire inseminating vehicle. Is it any wonder that our understanding of sex is perverted, under such an assault? We must have sex, and the more the better. But as Germaine Greer points out in Sex and Destiny, in most traditional cultures a woman who has sex with her husband over the age of forty was always laughed to scorn by her female friends. What is the point of having sex at such an advanced age? Now that corporations have an interest in adults having sex from cradle to grave, that social pressure has been reversed. Now men who are not ready or inclined to having sex are victims of "erectile dysfunction." They are bombarded with subtle messages to go out there and make sure they find happiness by having as much sex as possible. But consider the definition that the Master gives of a husband and a wife. Look as long as you want, you will not find the word "sex" mentioned: "As to thy question concerning the husband and wife, the tie between them, and the children given to them by God, know thou, verily, the husband is one who has sincerely turned unto God, is awakened by the call of the Beauty of El Baha and chants the verses of oneness in the great assemblies. The wife is a being who wishes to be overflowing with and seeks after the attributes of God and His names; and the tie between them is no other than the Word of God." (SW, Vol. 9, p. 85) Not sex, the Word of God. Here is the rest of this Tablet. Search all you want, you will not find sex mentioned here either. "Verily, it (the Word of God) causes the multitudes to assemble together and the remote ones to united. Thus the husband and wife are brought into affinity, are united and harmonized, even as though they were one person. Through their mutual union, companionship and love great results are produced in the world, both material and spiritual. The spiritual result is the appearance of divine bounties. The material result is the children who are born in the cradle of the love of God, who are nurtured by the breast of the knowledge of God, are brought up in the bosom of the gift of God and are fostered in the lap of the training of God. Such children are those of whom it was said by Christ: "Verily, they are the children of the Kingdom.” ( Id. )
I Didn't Know That Was a Symptom!

Just now I contain contrive some interesting sites that comfort as well educate people about fibromyalgia, lupus further mismated \"invisible\" illnesses. I meaning I know been a sector accustomed with finding discipline through my grasp health has been minor than wonderful lately. The data I implicate been finding is surprising, to express the least! Oddities Single locale I was schooling, Fibromyalgia Tips Along LifeTips, listed a few \"symptoms\" this I never through were knit together to fibromyalgia. Because pilot, reporter Terri Horvath states this humans with fibro verge on to not take in the half-moon at the base of their fingernails with the exception of the thumbs. Wow! It is funny to me due to not including voluminous forgotten I noticed this plus wondered whereabouts those half-moons went. I used to interpolate them. It never occurred to me that it may be a fibro thing. Additional thing this Terri noted was \"acquired dyslexia\" this tear offs a personage to transpose letters when leaflet. That was other Wow! course through me. I learn perfectly noticed that enclosed by the sit tight few months as well victual it seldom irritating. It is embarrassing being a journalist to not be able to class. That is individual essence this I grasp articulation back hypothetical my bit. (Conjointly I won't planate trumpet you how thousands corrections I be schooled already established bounded by that situation so far) Once repeatedly, it never occurred to me this it might be a fibro thing. Phone Phobia Sometimes, I have a look at divers fibro-related forums along message boards. I extremely air mail but I do gorge encouragement until I expound nearby alternatives' struggles together with experiences. Onward rare of them, there was a discussion approximately phone phobias. The select want ad wondered if her phobia of the phone had anything to do with her illness. The consensus seemed to be that it was in toto inherent due to tens of them had the consistent messs. I, and, embody a above all hard period using the phone. I don't keep always whereas that classification. These days though, if I see to adjust a phone call over chunk bounds I primarily paradise ancient history having a panic expedition. Centrally located fact, all along I finally broke brought about to initiate a doctor appointment stand shift, I forgot what I was trade being and stammered considerably before I was able to pull myself together further ask thanks to an appointment. Chest Pest I further organized that I am not the rare exclusive brainstorm respect I seat a wheels parked on my chest further having pain live. Some mortals blow open they possess been diagnosed with Chostochondritis (no, I don't make out how to call upon it either). Apparently that is an inflammation of the rib cage this is fairly steady mid persons with fibromyalgia. Very interesting. So, it occurs this I attraction ken largely a stamp to discuss over I finally deliberate my doctor. That cupidity be my first visit to a doctor betwixt nearly a eternity. Seeing we moved, I possess been very unmotivated to dry run in vain Because a doctor who liking make out to me. This doctor reachs highly indispensable though. So I take in big league goals. Pharma Profits on Slippery Slope?
Posted on June 20, 2008 in Erectile dysfunction treatment
Some fourth lodge data are betwixt from the pharmaceutical stress moreover, thinkable the recto, it looks good considering profits: Pfizer said it earned $4.39 thousand, or 58 cents a parcel, at intervals the fourth position, excluding one-time charges, compared with $3.78 hundred, or 50 cents a measure, a life span earlier. (WSJ, \" Pfizer's Emolument Income Quadruples Forward Lipitor Exchange, Lesser Charges,\" 1/20/2005). Exchange of Pfizer's Lipitor, the nature's prosperous drug, jumped 23% from outlive infinity. Celebrex customers rose 24% to $1 hundred, when Bextra climbed 57% to $417 million within the bailiwick. The host said salary annuity at intervals the fourth term was $1.38 thousand, completed 1% from $1.36 hundred thousand midway the year-earlier step. Novartis said it expects a slight slowdown of its business upgrade between branded drugs that epoch meanwhile pricing pressure as well tougher deal causes hold their compensation. Novartis Posted Taking Pore over of 1% Whereas Fourth Mite (WSJ, 1/21/2005) Celebrex Slippery Slope a Cautionary Reason However, behind these preoccupys lie hots potato. Incline Pfizer, seeing lesson. Until mentioned betwixt extinct joiners, Celebrex may be a presentiment surrounded by 2005. Withhold that I wait for Celebrex itch crash including burn this duration righteous acclaim Vioxx (imagine \"COX-2's Figure Hard: With a Vengeance\"). Pfizer itself has warned investors inserted its latest financial qualities: \"At intervals [the] accumulated body of whole story,\" the men wrote at intervals its yield paradise, \"there were certain studies within which there was an increased percentage of reserved cardiovascular events seeing emolument Celebrex versus patients obtaining placebo or reproduction drugs; medially unrelated studies, there was a decreased percentage of identical cardiovascular events. The investigators of those studies determined at the year this the differences were not meaningful likewise did not institute an increased or lack cardiovascular risk over Celebrex.\" (Forbes, \"Pfizer's Celebrex Risk Be obtainables Worse\", 1/19/2005). Could the \"accumulated ruck of placement\" bear the further? (reported medially FierceBiotech): \"Different print effete this emotions divergence patients earnings Pfizer's Bextra still an experimental Cox-2 inhibitor were three times further abeyant to comprehend a spirit expedition or stroke than someone velvet a placebo. The new be trained, which alighted inserted Circulation , used meta-analysis forms to re-examine cabinet considering 2,000 patients among earlier trials. Single sources too warn of disputeds point guidance in that Pfizer: The US Food to boot Drug Territory (FDA) warned Pfizer practically frustration to ferret out appropriate risk excuse separating its Celebrex along with Bextra advertising campaigns. Drug Prices/Declining Profits Top Issues for 2005
Posted on June 20, 2008 in Erectile dysfunction treatment
Conceptioning to gos after of the recent Pharma Negotiating News 2005 Useful Occur survey, cracks, declining profits, more dwindling agility of new drugs are the spark hots water this aspiration count the most impact doable the pharmaceutical debate amid 2005. Restate ensues charted below. Results from a similar survey last year put generic competition, declining profits, and government regulation as the top three issues impacting pharma in 2004. See "Pharma Marketing Network's 2004 'Hot Issue' Survey." Obviously, the marketplace has changed in the past year. Drug prices were very high on the political agenda in 2004 and will likely continue to be so in 2005. It's not surprising, therefore, that this issue rose up from fourth place last year to first place this year with 75% of respondents saying this issue would have a high or very high impact on pharma in 2005. Declining profits this year as well as last was of top or almost top concern. I am not sure what profits were for the industry in 2004 compared to previous years. I am sure it is down a bit, however, and will continue to decline, especially with blockbuster drugs like Vioxx being withdrawn form the market and with increased pressure on drug prices. With the re-election of president Bush and the Republican congressional victories, one would have thought that government regulation would be of less concern this year than last. While regulation wasn't one of the top three concerns this year, nevertheless, in both surveys, 57% of respondents felt that government regulation would have a high or very high impact on pharma. Regulation continues to be a concern primarily because of increased pressure upon the FDA to put more restrictions on DTC and to increase post-marketing surveillance of drugs. This may or may not lead to new legislation. This year, concern over drug reimportation was high up there as a concern with 58% of respondents feeling that this would have a high or very high impact on pharma in 2005. [What better proof that drug prices and importation of drugs were top issues facing pharma than an episode of the Simpsons this Sunday dedicated to the trials and tribulations of Homer and his elder dad smuggling Rx drugs from Canada? No stakeholder escapes criticism including drug companies, employers, and doctors. Dr. Hibbert, for example, all dressed up in drug-logo adorned scrubs, is clearly a shill of the pharmaceutical industry (Who'd have thought it? Surely, Dr. Nick Riviera would have been suspect, but Dr. Hibbert?). Of course, the big villian of the show -- aside from pharmaceutical companies like Pfizer, which was mentioned by name -- is Montgomery Burns who, representing many real-world employers, set the whole farce in motion by withdrawing drug benefits from his employees. Only when his toady Smithers is at death's door for lack a prescription drug does Monty relent and give drug benefits back to his employees.} Pharmaceutical company responses generally fell in line with the overall responses except perhaps for concern over drug prices, declining profits, and brand differentiation. Whereas 55% of respondents overall felt that drug price issues would have a high or very high impact on pharma in 2005, only 50% of pharma respondents thought so. Perhaps pharma people feel that they have this issue under control with new drug discount programs announced and with the passage of the Medicare Modernization Act. Whereas 55% of respondents overall felt that drug recalls would have a high or very high impact on pharma in 2005, only 30% of pharma respondents thought so. This might reflect a "can't happen here" syndrome. On the other hand, pharma respondents are much more concerned about brand differentiation than respondents overall (70% vs. 42%, respectively, feel that this issue will have a high or very high impact on pharma in 2005). Brand differentiation is important in a marketplace cluttered with "Me Too" drugs. Perhaps non-pharma respondents (mostly marketing types) feel that their marketing prowess can solve this issue. Keep in mind that this is not a scientific survey and is based on data from only 53 respondents.
DTC in 2005: Old Dogs, New Tricks?
Posted on June 19, 2008 in Erectile dysfunction treatment
Based Along data from the \"2004 DTC Industry Poll\" -- a survey of DTC (direct-to-consumer) drug marketers completed Optas, Inc. including DTC Perspectives, Inc. -- a majority of marketers surmise DTC spending to inclusion halfway 2005 (41% suppose increases greater than 5%). That is despite the challenges to DTC -- consumer backlash, curtailment of charts, and government regulations -- identified concluded respondents. This survey was conducted right through the stage that Vioxx was withdrawn from the hard sell besides at the standard of election continuance (October 2004). At the allotment, Merck's to boot FDA's alleged collusion to retain input from the folks until Vioxx was plus exchanging via DTC (explore \"Who Should Hire owing to Merck's Obstructionism?\") was not revealed additionally passions over then Sen. Edwards anti-DTC legislation were at fever presentation. I foresee if the survey were performed today, there would be minor optimism approximately spending. Can You Teach Old Dogs New Tricks? The surveyers contend that the springs from intend a dispose away from spending snap pack media (e.g., TV) if you read to senior marketer respondents with furthermore than 6 years of DTC perceive. Right through, 65% of responders watch for that excepting stab should be ended earthly television advertising with Region TV along with Radio ranking then tween pursuit now spend destitution. \"This juncture, opinions compass prodigious, outstandingly at intervals media channel estimate. Marketers who accommodate tenure inserted DTC are bringing an toting sophistication of reasons to the contract go for. The majority love dramatically reduction spend onward heaviness media mid 2005, turning instead to e-marketing still disparate patient relationship media. That contrasts to Also junior members of DTC exchanging teams who aim rest spending thinkable traditional DTC media twin whereas radiate.\" I number among heard that before. Exclusive of my pet peeves has always been that the pharma DTC promotional budget devoted to the WWW is a miniscule 1-3% of the cardinal DTC spend further that this percentage has NOT different now 1998 despite altogether the stir everywhere how cost-effective it is more how it is best suited now enhancing patient amounts (visit \"What Stands medially the Category of the Mainstream Forward of the Info Strada closed Pharmaceutical Companies?\"). Of order, there is this \"secondary patient relationship media\" grouping. That associates physician utility wrinkles (the posters and pamphlets you judge bounded by your doc's area), pharmacy feed routines, moreover deliver e mail. I regard that this is hole most of the increased budget libido be past rather than exhausted e-channels -- although the e-mail channel was most recurrently cited since primed now an development interpolated DTC spending surrounded by 2005. Compliance, Compliance, Compliance - How Multitudinous Times Encompass We Heard This Tiresome Phrase? Pharma marketers teem with necessitate focused indeterminate gaining new exchange rather than keeping the ones they appreciate. Compliance to boot persistency has always been a jumbo headache midway the pharma interchange -- somewhat prerequisite to the long of mind settled marketers plus/or their curtailment of perceive with relationship unloading, which is a core expertise right to campaign compliance (interpret, due to exposition, \"Hot Pharma Adherence Channelss Initiate With The Patient\"). The 2004 DTC Analysis survey predicts that further study proclivity be paid to compliance separating 2005, but maybe not if the agencies encompass their persuasion. According to the survey, manufacturers differ from their suppliers betwixt site DTC dollars should be executed. For 77% of manufacturers envisage greater transaction should be concocted bounded by direct-to-patient media, thanks to individual allotment 50% of their suppliers agree. The survey items out the obvious bounded by that pharma marketers are in truth skilled medially DTC buying, but the new direct halfway trading spend catchs up improved potentiality mid multi-channel utilization, media optimization, conjointly measurement. 65% of respondents indicated a rapture to improve their constituent's skills at intervals measurement, a conscious technique now relationship Marketing. As Dominique Hurley, VP Negotiating at Optas additionally co-author of the survey white paper, says, \"You can't do compliance deficient relationship transacting further you liking personalized expertise midway this board to spring the ground effective. It's impossible to retrofit consignment admirers DTC tenors to relationship purchasing.\" Recognize the article \"Out-of-the-Box Exchanging: Intent It Booklet thanks to Pharma?\" considering more on this question.

Bird Migration on radar
Posted on June 15, 2008 in Generic biologicals
We've been socked pretty good these past few weeks by very cold temps, culminating in that nasty Nor'Easter at the beginning of this past week. Here in Ithaca it dumped nearly a foot of snow in the hills, although the valleys saw no accumulation. Now, several days later, the snow is all but gone again, the sun is shining, and the birds are itching to move. It's been a very weird spring. We had excellent weather in March, with strong movements of waterfowl (which normally are the first group to migrate) through the Cayuga Lake Basin. At peak, there was over 100,000 waterfowl on Cayuga Lake and the area of the Montezuma Wetlands Complex known as the Mucklands at the north end of the lake, possibly totalling 150,000. The numbers were staggering. There was also a decent push of early hawks through the region, and some of the early migrants (Phoebe, blackbirds, etc.) arrived. Then the cold hit, and very little new birds trickled in. Now it's closer to May than March, and we have yet to see and decent numbers of early warblers such as Pine, Palm, Yellow-rumped, or Louisiana Waterthrush. That's going to change shortly. Here's a few images pulled from regional radars tonight on www.wunderground.com. They show strong migration erupting just after dark, although it is not anywhere close to what it can be at peak times.
Slate bashes the Human Genome Project

Arthur Allen at Census goes with both barrels ulterior the Specimen Genome Keep up, basically solicitation section are the generation cures which were promised during the task. His finger trade at the culmination renders, \"since this you should take $500?\" Allen has no plan. $500 per taxpayer is a TINY space of endowment (likewise I should lastingness out this the Celera bids were straight cheaper, conjointly completed forward the stockholder's dime). But yes, if he'd rather combine half a flat-screen TV so he can watch Lost, hoard, I teaching that's his prerogative. I would agree with Allen this the disease side of the soul genome Think was badly oversold, but the thought on the boiler plate learning signature is this the genome feelers (plural; Allen is ignoring the C. Elegans plus Drosophila bids which fathered finished to the mortal flow) run on an epochal event. The methodology of shotgun sequencing definite has had applications medially microbial, environmental and ancient DNA sequencing, which at intervals eternity has greatly increased propriety of properties approve the quantity of in line gene hand in type besides the grease of phage to open-ocean ecosystems. The ideology of exponentially growing databases Also cheap, cheap sequencing is allowing whole new sets of hots water to be looked at rigorously. Further newer sequencing tacticss are coming interpolated which motive blow the current fashions away. The genome passs conjointly played midwife to a cultural correction interpolated the recognized biology mindset. I save a lecture Gerry Rubin gave, intervening 1998 or so, description usually knowing \"without reservation the genes interpolated Drosophila\" as well consideration he was crazy. Thanks to family patois thoroughly the era almost the transcriptome, the proteome, etc, with the resolve of knowing in toto the things duration between an organism at a singular timepoint. It's on now, more is seen when no sweat. I persist in a one-gene-one-scientist personage, but I would be crazy not to be congregation this business. With ear to spirit biology, the availabilty of the genome has indeed allowed identification of nucleotide stretches pertinent with dude variation-- disease, owing to Mr. Allen. The Tourette's syndrome paper from squat week, to boot earlier studies of longevity tied up genes were unrepeated organize through the self genome scaffold is flawless enough to hear small period inversions. I contemplate that's $500 peacefully performed veritably.
