I don't know why people dig him so much.) Most modern Christians read the Bible, in fact they STUDY the Bible, and I don't think that was always so. Certainly that was not true back in the day when nobody could read the Bible because it was in Latin. Reading the Bible doesn't really lend itself to anti-Semitism. Come to think of it, there may be a pretty direct relationship between the percentage of Christians who read the Bible, and the lessening of anti-Semitic violence. And as long as I'm thinking with my fingers, (by typing I mean) I have to say that 400 years ago Christianity was a lot more like Islam is in the Middle East today. A bunch of assholes were in charge of the religion AND the government, and when people got pissed off at the religion and/or the government they blamed the Jews. Hmm... But Muslims today read the Koran, so the theory breaks down. Or do they? How many Muslim in Saudi Arabia actually read the Koran? Let's assume all those who CAN read do read it. It is the best decision I ever made. Two years ago, there was a man I knew I like hanging out with. A man who made me laugh. A man who was a musician on the side. A man whose real job I couldn't even explain at the time. He was a good guy. He was a better guy than the other guys I was seeing, but he had baggage. And he was older than me. By about a decade. One night, we sat in his car after a casual dinner of comparing divorce notes, lawyer fees, the prospect of dating again, and life upheaval in general, he turns to me and says, "I want to tell you something, and it will mean that you will either never want to see me again, or quite the opposite. I think we would be good together." What did you say? "I think that we would be good together, and I want to see it happen. I want to be with you." There was no real conversation. I stared out the window in complete disbelief while he went on about the life he saw us having together until he finally said, "You are scaring me with your silence. On the other hand, if the provisional application contains at least one claim, even if it is not a very good claim, the regular application will be entitled to its filing date. A set of new claims may always be added at some time in the future before the application is examined. [LBE note: filing a nonprovisional application claiming priority to a provisional application is probably best not viewed as filing a continuation application under 35 USC 120. The above paragraph is simply wrong.] Other patent attorneys believe that it is best to avoid having any claims in the provisional application. The reason for this is that usually any claim that exists in the provisional patent application will be changed when the application is filed as a regular, non-provisional application. There is concern that this changing of the claims when filing the regular application might be construed by a court as an amendment of the claims which, according to the recent ruling in Festo Corp. v. Shoketsu Kinzoku, 187 F.3d 1381, 56 U.S.P.Q.2d 1865 (2000), would severely limit the extent to which the claims could be broadened under the doctrine of equivalents. Because the issue has not yet been litigated in a court, it is not at all certain that changing the claims during the filing of a regular from a provisional application would indeed be considered an amendment that would limit the scope of the doctrine of equivalents. However, until the issue has been cleared up, I concur that provisional applications are best filed without claims. [LBE note: as of 2005, I don't believe anyone has ever asserted Festo estoppel because of a narrowing amendment between a nonprovisional and an earlier provisional. I doubt this will ever happen. "Claims" in a provisional are not claims presented for consideration to the USPTO and are never examined. Krajec's reasoning is not persuasive. Hard to believe there would be estoppel arising from a provisional. If the use of the word "claims" bothers anyone, have a numbered list preceded by "I disclose." In a case wherein a provisional comes into play, the PTO is looking for written description support for priority. They are not looking for estoppel on claims.

WOW, IT'S BEEN A WHILE

Do I really have to explain why I haven't posted in months? Since my last post, I have managed to refinish two pieces of furniture for Mary Addison's room, install shelves in her closet, hang a porch swing (to swing her), tile our kitchen and pantry floor (Ju just talked me into that in the middle of everything else), research all the cool things that she will need ( like baby monitors), and so on. Today I realized that it is 80 degrees outside, and I have yet to START on servicing my boat that I planned to do over the Winter. Hmmmm... something's coming before my boat? I'm in love with a little girl that I haven't even seen yet! But, enough about her. Tomorrow is our 4th anniversary. We are going to Atlanta for the weekend to celebrate our last childless anniversary. We're both taking a much needed day off of work, and making a long, fun weekend of Atlanta. We can't get much further away right now. I looked back at my blog posts for the last 2 anniversaries, and it's funny how quickly things change sometimes. My post in 2005 stated that one of our goals for the year was to have a baby, then last year's said that we would be celebrating our anniversary in Virgina with a visit to the fertility doctor. God is good. Julie has continued to do very well with her pregnancy. She's felt much better than expected although she does stay very tired. For the first time in our relationship, I actually get out of bed before her now. For those of you that know Julie very well, you understand how big of a deal that is. We had a baby shower two weeks ago, and it was a blast. I loved seeing everyone, and we got a ton of great gifts. We just had fun!
